Traffic violations lawyers practice a form of criminal law. The police officer could legally take a person into custody for refusing to sign the summons (virtually guaranteeing the need for a lawyer). Signing allows the alleged offender to go free on his or her own recognizance, pending the court date indicated on the ticket. The court date allows the driver to contest the charge or plead guilty.

It is possible to consult an attorney who specializes in traffic issues regarding the levied charges to see if a professional defense is warranted. It is advisable for CDL drivers who are charged with driving violations while operating a commercial vehicle to retain the services of an attorney, as the penalties are harsher for offenses committed by commercial interests. Persons charged with driving under the influence and bodily harm using a motor vehicle should also seek legal aid.
